Murder Charges In Toddler Death

Four men earlier arrested in connection with a neighborhood shooting that led to the death of a 5-year-old Omaha girl now face charges more directly tying them to the girl's death.

Omaha police say the four men were booked on the new charges Wednesday morning in the January 15 death of Payton Benson.

Police have said Payton was eating breakfast in her family home when she was struck by a stray bullet.

Douglas County Attorney Don Kleine tells Newsradio 1110 KFAB 20-year-old Vincent Hicks fired the fatal shot from an assault rifle and that he and two others were shooting at a rival gang member. 

Hicks has been booked on suspicion of first-degree murder, criminal conspiracy and three felony weapons counts.   22-year-old Adonus Moses has been booked for criminal conspiracy to commit second-degree murder. 

18-year-old Jaylen Montgomery now faces three weapons charges and 21-year-old Jacob Brown faces two weapons charges.

Police Chief Todd Schmaderer commented on the arrests saying "these arrests are the product of a community that has stepped forward to assist law enforcement, coupled with gang and homicide detectives that have worked tirelessly to solve this case." 

All four men will be in court on Thursday
